Tata Dealer Sells 'Accident Nexon' As New SUV: Consumer Court Orders 18 Lakh Refund

Buying a new car is a dream for many in India. Most people wait for years and spend their life savings on their new car. We have come across incident where people have reported issues with the product or service of the dealership. There have been cases where dealers have intentionally sold cars with defect to customers. Here we have one such case from Karnataka where customer was sold a defective car from a Tata dealership. The customer went to the court and the court has now asked the dealership to compensate the customer with Rs 18 lakh for selling defective car.

The video has been shared by Vijaya Times on their YouTube channel. As per the report, the customer who is a doctor by profession went to a Tata Motors dealership in Bengaluru. The customer went to Key Tata which is a Tata Motors authorised dealership at Kanakpura, Bengaluru. The customer for some reason didn’t inspect the vehicle at the time of delivery.

Soon after taking delivery, the customer started facing issues with the vehicle. The car had several rusted panels, The doors of the car were misaligned, boot was repainted along with many other panels. The report also mentions that some parts of the chassis were also welded.

The customer took the car for a long drive once and during the trip he realised that there was some foul smell inside his cabin. The AC pipe of the car damaged he noticed that the AC vents were throwing hot air even with the recirculation on. There was no insulation on the engine bay. He also noticed that he could smell the fuel inside the cabin after driving the car for some distance. The door sensors were also not working properly as they were unlocking on its own after the car picks up speed.

The owner realised that the car had too many issues. He decided to take the car back to the dealership and report all the issues. He asked the dealership to get the issues fixed. However, the dealer ignored it. The owner of the car then decided to involved higher authorities and started writing mails to Tata officials.

Surprisingly, even they ignored the mails and the customer never got a response. It was then that the Nexon owner decided to move legally. He got in touch with a lawyer and filed a complaint at the consumer court. The lawyer decided to get an opinion about the car from an independent garage.

The garage owner highlighted even more issues in the car and it was finally revealed that the car sold to customer was in fact a damaged car that was involved in a major crash. The dealership decided to repair the car and sell it to a customer. It was clear that the dealership did this for their own benefit. The customer was able to prove his part at the court and after analysing the case, court ruled a judgement in favour of the customer.

The court asked the dealership to compensate the customer with Rs 18 lakh for selling defective car. The court also asked the dealership to repair the vehicle completely and return it to the customer. The dealer had agreed to compensate in the court but, the customer has allegedly not received the compensation till now.
